Actor Djimon Hounsou has initiated legal proceedings to establish custody arrangements for his two children with former partner Ri'za Marie Simpson, filing court documents in late January that seek joint legal and physical custody of the pair's son and daughter.
The custody filing comes several months after a December incident in Atlanta that resulted in Simpson's arrest on charges of simple assault and obstruction. According to police reports, Hounsou contacted Atlanta authorities claiming Simpson struck him in the face after he requested she leave his residence. Simpson was subsequently arrested on charges that included allegedly providing false information to officers.
The "Gladiator" star's court filing addresses custody of two minor children: a son born in 2022 and a daughter born in 2023. Hounsou is requesting shared legal and physical custody of both children, a proposal that has drawn a measured response from Simpson.
In her legal response, Simpson agreed to shared legal custody but argued that primary physical custody should be awarded to her. She cited the differing employment and travel schedules of both parties as justification for her position, suggesting that her circumstances would provide greater stability for the children's day-to-day care.
Simpson has also requested financial support from Hounsou, stating in court documents that the dissolution of their relationship has had a significant impact on her finances. The request for child support is a standard component of custody proceedings, particularly when there exists a substantial disparity in earning capacity between parents.
Following the December arrest, Simpson obtained a temporary restraining order against Hounsou. However, she later dismissed the protective order after the former couple reached an undisclosed agreement. The dismissal of the restraining order does not resolve the underlying custody dispute, which remains active in family court.
The case represents a complex intersection of domestic relations law and the unique challenges faced by high-profile individuals navigating custody arrangements. Courts typically prioritize the best interests of the children when determining custody, considering factors such as parental fitness, stability of living arrangements, and the ability of each parent to meet the children's physical and emotional needs.
Hounsou, who has appeared in numerous major film productions including his role in "Gladiator," faces the challenge of balancing a demanding career in the entertainment industry with the responsibilities of shared parenting. Simpson's argument regarding travel histories suggests that the actor's professional obligations may require extended periods away from home, a factor that family courts often weigh when determining physical custody arrangements.
As the legal proceedings continue, both parties will likely be required to submit detailed parenting plans outlining proposed custody schedules, decision-making protocols for major life decisions affecting the children, and financial arrangements for their care. The court will ultimately determine whether joint physical custody is feasible or whether primary physical custody with one parent better serves the children's interests.
