While marijuana may be legal in New Jersey, the rules around cultivation and distribution remain strictly regulated — a reality that has landed one man behind bars awaiting sentencing.
According to the Atlantic County Prosecutor's Office, Hui Chen, 49, of the People's Republic of China, has pleaded guilty to charges of maintaining a drug production facility and conspiracy to distribute drugs. The case centers on an illegal indoor marijuana growing operation that Chen allegedly ran at a property located at 147 Fursin Avenue in Buena Vista, New Jersey.
The operation came to light on January 30th, when law enforcement executed a search warrant at the Buena Vista address. What they discovered was substantial: authorities seized 728 marijuana plants from the indoor growing facility, underscoring the scale of the illegal operation.
This case serves as an important reminder to our community that New Jersey's legalization of marijuana comes with significant restrictions. While adults can legally purchase cannabis from licensed dispensaries, growing and selling marijuana without proper licensing remains a serious criminal offense. The state maintains tight control over who can cultivate and distribute cannabis products, requiring extensive permits and regulatory compliance.
Chen is currently being held in the Atlantic County Jail as he awaits sentencing, which is scheduled for May. Prosecutors have indicated that the State of New Jersey will recommend a sentence of six years in prison — a substantial penalty that reflects the seriousness with which authorities treat illegal cultivation operations, even in an era of legalization.
The case highlights ongoing challenges law enforcement faces as they work to distinguish between legal, regulated cannabis businesses and illegal operations that circumvent the state's licensing and taxation systems. For residents wondering about the boundaries of marijuana legalization in New Jersey, this prosecution makes clear that homegrown operations and unlicensed distribution remain firmly off-limits.
