New court documents reveal that Aaron Carter was under investigation by the Department of Children and Family Services before his death in 2022, a detail that will now become central to the wrongful death lawsuit filed by his family.
Dentist Jason Mirabile, named as a defendant in the lawsuit, disclosed his intention to present evidence from the DCFS investigation during the upcoming trial, according to court filings obtained by TMZ. The dentist plans to challenge claims that Carter's 4-year-old son, Princeton, suffered a significant loss of companionship, arguing the late singer was not an adequate parent.
Mirabile indicated he will call Department of Children and Family Services staff members to testify as witnesses in the case. The nature and findings of the DCFS investigation have not been publicly disclosed.
The dentist also disputed financial claims made by Carter's family regarding the singer's earning potential. According to the filing, Mirabile expects the family to argue that Carter was generating millions of dollars annually from multiple income streams, would have maintained that earning trajectory, and intended to tour in 2023.
Mirabile characterized the claim for loss of financial support as highly contested, asserting there is no substantiation that Carter earned a seven-figure income in the years preceding his death.
The Carter family's lawsuit alleges that both the singer's physician and dentist acted negligently in prescribing medications to him, with particular focus on Xanax. The family contends this negligence contributed to his death.
Carter died at age 34 after overdosing on Xanax and an opioid medication, which caused him to lose consciousness and accidentally drown in a bathtub. The medical examiner also determined that Carter had been huffing at the time of his death.
The case continues to move through the legal system as both sides prepare for trial, with the DCFS investigation now positioned as a key element of the defense strategy.
